This Acceptable Use Policy ("AUP") governs your use of the Songclimber Service and client portal. It applies to all content you submit, all accounts you connect, and all ways you interact with the Service. Violations of this policy may result in service suspension or termination per Section 7 of the Terms of Service.
This policy exists to protect you, Songclimber, and the platforms we operate on. The Service runs at high volume and consistency — anything that puts your accounts or our system at risk affects everyone.
01Content Standards
All content you submit or authorize us to post must comply with the following standards.
1.1 You Must Have Rights to Everything You Submit
- You must own or have a valid license to all footage, music, images, and other materials you provide.
- You must hold all necessary music rights for any recordings used, including master rights, sync rights, and publishing rights.
- You may not submit content that infringes any third party's copyright, trademark, right of publicity, or other intellectual property rights.
1.2 Prohibited Content
You may not submit, and we will not post, content that:
- Is defamatory, harassing, threatening, or abusive toward any individual or group.
- Incites violence or promotes hate speech based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
- Is sexually explicit or pornographic.
- Depicts or promotes illegal activity, including drug trafficking, weapons offenses, or financial fraud.
- Contains malware, phishing links, or deceptive content designed to harm or deceive users.
- Impersonates another artist, public figure, brand, or entity.
- Makes false or misleading claims about your music, career, streaming numbers, chart positions, or accolades.
- Violates the community guidelines or terms of service of any connected platform (TikTok, Instagram, YouTube, Facebook).
- Is spam or repetitive low-quality content designed to game platform algorithms in violation of platform rules.
1.3 Account Types and Content Scope
Songclimber operates three types of accounts under the Service:
Artist-Owned Accounts
Content must relate to your music, brand, or artistic identity. You may not use your artist account to distribute content on behalf of other artists without those artists' explicit permission and a separate agreement with Songclimber. You may not use the Service to infringe on another artist's sound, trademark, or likeness.
Faceless Niche Accounts
Faceless niche and fan accounts are agency-operated accounts managed by Songclimber on your behalf or as part of a label or roster engagement. These accounts are created, maintained, and posted to by Songclimber as a standard part of your service agreement. Content for these accounts must be provided or approved by you and must not misrepresent the source, nature, or ownership of the account in a way that deceives platform users or violates platform rules.
Fan and HQ Accounts
Fan and HQ accounts operate under a fan or supporter identity and are managed by Songclimber under your direction. Content posted to these accounts must be consistent with the account's stated identity and must not be used to artificially inflate engagement, deceive platform algorithms, or misrepresent the relationship between the account and the artist it supports.
All account types are subject to the content prohibitions in Section 1.2 and must remain compliant with the terms of service of each connected platform.
02Account & Platform Conduct
2.1 Your Account
- Keep your portal login credentials secure and do not share them with unauthorized parties.
- Do not attempt to access any other client's account, data, or content.
- Do not use automated tools, bots, or scripts to interact with the portal outside of your normal client access.
2.2 Connected Social Media Accounts
- Do not take actions on your connected accounts that conflict with or undermine the Songclimber posting schedule without notifying us first.
- Do not independently post content at a volume or frequency that could confuse or disrupt the pipeline.
- Do not revoke platform access during an active posting period without giving us 48 hours notice — doing so may result in missed posts you are still responsible for under your SOW.
- Do not use your connected accounts for any activity that violates the platform's terms of service.
- Do not attempt to manually intervene in Instagram Trial Reel graduation decisions or reverse eligibility determinations made by the platform or by Songclimber's managed process.
2.3 Account Health
You are responsible for maintaining your social media accounts in good standing. This includes:
- Not engaging in follow/unfollow schemes, comment pods, or artificial engagement tactics on your owned accounts.
- Not purchasing followers, plays, or engagement on accounts we post to.
- Not using third-party tools that violate platform terms on accounts connected to the Service.
Songclimber is not liable for account restrictions, suspensions, or bans resulting from your actions on your own accounts outside of our posting activity.
03Portal & System Use
You agree not to:
- Attempt to probe, scan, or test the vulnerability of the Songclimber system or any related network.
- Attempt to breach or circumvent authentication or security measures.
- Use the portal in any way that could damage, disable, overburden, or impair the Service.
- Scrape, harvest, or extract data from the portal through automated means.
- Reverse engineer, decompile, or attempt to extract the source code of the portal or any Songclimber software.
- Attempt to reverse-engineer how analytics data is compiled, or access connected platform APIs through Songclimber's infrastructure outside of your normal client access.
- Use the Service for any purpose other than managing your own Songclimber engagement.
04Communication Standards
When communicating with Songclimber team members you agree to:
- Engage respectfully and professionally.
- Not engage in harassment, threats, or abusive communication toward any Songclimber employee or representative.
- Not attempt to manipulate, pressure, or coerce Songclimber into actions outside your SOW.
We reserve the right to terminate service with immediate effect if any team member is subjected to abusive or threatening behavior.
05Compliance With Law
You agree to use the Service in compliance with all applicable federal, state, and local laws, including but not limited to:
- Copyright and intellectual property law.
- FTC guidelines on endorsements and disclosures (if applicable to sponsored content).
- CAN-SPAM Act and applicable email and messaging regulations.
- State and local laws applicable to your music career and business activities.
06Reporting Violations
If you become aware of content posted to your accounts through the Service that you believe violates this policy, or if you believe another party is misusing the Service, contact us immediately at evan@songclimber.com.
07Enforcement
Songclimber reserves the right to:
- Remove or refuse to post any content that violates this policy.
- Issue a warning for first-time or minor violations.
- Suspend service with notice pending investigation of a potential violation.
- Terminate service immediately and without refund for serious or repeated violations, including but not limited to: submission of infringing content, platform account abuse, system interference, or abusive conduct toward our team.
Termination for AUP violations is treated as termination for cause under Section 7.4 of the Terms of Service. Outstanding fees remain due.
08Changes to This Policy
We may update this AUP from time to time. We will notify you of material changes by email at least fourteen (14) days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance.
